1. Scope These Terms & Conditions govern the working relationship between Tim Wachnowski Postproduction GmbH ("Contractor") and its clients ("Client"). They apply to all current and future services, even where not explicitly re-stated. Any deviating client terms require the Contractor's express written acknowledgement. These terms apply exclusively to businesses as defined under § 14 BGB.

2. Contract & Quotes A contract is formed upon the Client's acceptance of a binding offer, or upon the Contractor's written confirmation of a commission. Quotes are valid until the date stated and are based on information available at the time of issue. Individual line items may vary within the total budget. Quotes may be approved by phone or email. Unforeseen retouching or additional work will be invoiced by arrangement. Quotes become binding only after the material has been reviewed and the underlying information confirmed. Changes to schedule or production timeline may result in revised pricing.

3. Invoicing & Payment The final invoice is due within 14 days of issue and delivery of final files. Please reference the invoice number on all transfers. In the event of cancellation or production abort, 50% of post-production costs and 100% of third-party and incidental costs will be charged.

4. Production & Delivery Quotes are based on the exchange rate valid at time of issue. Deliverables are specified in the quote. Files are delivered as closed files in the eciRGB profile via the Contractor's server. Files remain available for download for 30 days. Re-delivery after this period will be invoiced separately. The Contractor's archiving obligation ends 30 days after delivery.

5. Communication Each project includes up to 2.5 hours for meetings, calls and conferences. Additional time is billed at €75.00 net per hour.

6. Approval & Liability The Client must review all delivered work immediately upon receipt. Approval is considered granted if no written objection is raised within seven days, or if the work is put into use. The Contractor is liable only for intent and gross negligence. Liability for indirect damages, loss of profit or data loss is excluded unless mandatory statutory provisions apply.

7. Self-Promotion The Contractor retains the irrevocable right to use project work and imagery for self-promotional purposes, unless explicitly excluded by written agreement.

8. Jurisdiction Place of performance and jurisdiction is Düsseldorf, where the Client is a merchant, legal entity under public law, or a special public fund. Should any individual provision be invalid, the remaining terms remain unaffected.

PRIVACY POLICY

We take the protection of your personal data seriously. All personal data is handled confidentially and in accordance with applicable data protection law.

Our website can generally be used without providing personal data. Where personal data is collected — name, address, email — this is done on a voluntary basis and will not be shared with third parties without your explicit consent.

Contact Form — Enquiries submitted via our contact form are stored solely for the purpose of processing your request. This data is not passed on without your consent.

Data Use — Personal data is collected only to the extent you provide it, and used exclusively to fulfil and process your order. After completion, data is retained in line with statutory retention periods and then deleted, unless you have consented to further use.

Cookies — This site uses cookies to improve usability and performance. Most are session cookies, deleted automatically after your visit. You can configure your browser to restrict or block cookies at any time.

Google AdWords & Analytics — This site uses Google AdWords Conversion Tracking and Google Analytics to analyse usage and improve our offering. IP anonymisation is active. SSL Encryption — This site uses SSL encryption for all data transfers. An encrypted connection is indicated by "https://" in your browser's address bar.
